COMPLAINANT: Vehicle Sales Authority of BC (the “Authority”)
LICENSEES: 715 Motor Haus Ltd. (“715”) and Hao Guo (“Mr. Guo”)
Allegations:
It was alleged that 715 and Mr. Guo altered and fabricated various consumer financial documents that were used by 715 in sixteen applications for financing for customers who purchased vehicles from 715.
Following a written hearing, it was determined that 715 and Mr. Guo contravened the following legislation:
Section 33(2)(h) of the MDAR for failing, in the course of business, to safeguard records in respect of a consumer that were in their possession or control.
Issues at hearing:
In the course of the hearing, the Registrar made evidentiary rulings concerning the admissibility of evidence and with respect to procedural fairness issues.
Penalty:
The Registrar found that the circumstances did not warrant cancellation of either 715’s motor dealer registration or Mr. Guo’s salesperson license and directed the parties to provide written submissions as to penalty.
The Registrar further found that the Authority was entitled to its costs, including actual legal costs, and directed the parties to provide written submissions as to the quantum of costs.
