COMPLAINANT: Vehicle Sales Authority of BC (โ€œthe Authorityโ€)

LICENSEES: Karan Sharma

ALLEGATIONS:

The Vehicle Sales Authority of British Columbia (โ€œthe Authorityโ€) alleges that Karan Sharma contravened section 35(3)(a) of the Motor Dealer Act (โ€œMDAโ€) and section 33(2)(a) of the Motor Dealer Act Regulations (โ€œMDARโ€) by supplying false and misleading information to a person acting under the MDA and by failing to act with honesty and integrity in the course of business.ย  As a consequence, the Authority sought the revocation of Mr. Sharmaโ€™s salesperson license and the imposition of a re-application waiting period in the range of five to ten years.

ORDER:

The Registrar found that each of the allegations were proven on a balance of probabilities.ย ย  Mr. Sharma made false written representations in the course of a previous Registrarโ€™s hearing, he threatened an employee of the Authority during a telephone call and he failed to adhere to conditions on his salesperson license by not advising his employer of the conditions and by not advising the Authority of the change in his employment.ย  The Registrar found that it was not in the public interest that Mr. Sharma continue to be licensed and ordered that his salespersonโ€™s license #302815 be revoked effective immediately and that the Registrar not accept an application for licensing from Mr. Sharma for a period of five (5) years from the date of the decision.
