COMPLAINANT: Vehicle Sales Authority of BC (the “Authority”) 

LICENSEES: Canwest Auto Inc. (“Canwest”)

                                                                                                                                                           

ALLEGATIONS:        

It was alleged by the Authority that Canwest sold a vehicle to a consumer and failed to disclose several material facts on the purchase agreement, failed to act with honesty and integrity in the course of business and engaged in a deceptive act or practice in respect of the consumer transaction contrary to f the Motor Dealer Act Regulation, (“MDAR”) and the Business Practices and Consumer Protection Act (“BPCPA”).

FINDINGS

The Registrar found that Canwest contravened the following sections of the MDAR:

Section 21(1)(a) of the MDAR by failing to include its address in the purchase agreement.

Section 21(1)(h) of the MDAR by failing to include the actual selling price of the Vehicle in the purchase agreement.

Section 21(1)(i.1) of the MDAR for failing to include the correct tax payable in the purchase agreement as required by the Provincial Sales Tax Act.

Section 21(1)(j) of the MDAR for failing to include the correct down payment or deposit in the purchase agreement.

Section 21(1)(l) of the MDAR for failing to include in the purchase agreement an itemized list of the cost of any other charges for which the purchaser is responsible if they are to be added to the contract price.

PENALTY:

The Registrar issued an administrative penalty to Canwest in the amount of $7,500.00.

The Registrar also ordered Canwest to reimburse the Registrar’s actual costs, including actual legal costs in the amount of $2,500.00.
