COMPLAINANT: Vehicle Sales Authority of BC (“the Authority”)

LICENSEES: 640353 Ltd. dba Chilliwack Mitsubishi (the “Respondent”)

CONSUMERS:  Chelsea Couvrette and Graham Marshall

ALLEGATIONS:

The Authority alleged that the Respondent contravened the Motor Dealer Act (“MDA”), the Motor Dealer Act Regulation (“MDAR”) and the Business Practices and Consumer Protection Act (“BPCPA”) by acting as a motor dealer at a place other than its place of business, by forging Mr. Marshall’s signature on a purchase agreement and by committing or engaging in a deceptive act or practice in relation to a consumer transaction.  The Authority sought a suspension of the Respondent’s motor dealer registration, or alternatively an administrative penalty as well as reimbursement of the Authority’s actual costs, including actual legal costs.

ORDER:

The Registrar found that the Respondent committed or engaged in a deceptive act or practice in respect of consumer transactions with Chelsea Couvrette and Graham Marshall contrary to 5(1) of the BPCPA.  The remaining allegations were dismissed.  The parties were directed to prepare a schedule for the exchange of submission concerning penalty or enforcement.
