ALLEGATIONS:
The Authority alleged that the Respondents engaged in a deceptive act or practice by misrepresenting the standard and quality of a vehicle that it sold to the Consumer Complainant and that it further failed to state a material fact. The Authority further alleged that the Respondents failed to indicate on the purchase agreement that the vehicle was not suitable for transportation and that it aided, abetted or caused the Consumer Complainant to contravene the Motor Vehicle Act by allowing him to drive the vehicle from the dealership onto a public road.
The Consumer Complainant sought reimbursement of his down payment and monthly loan payments made to date as well as his out-of-pocket repair expenses and to be relieved of any remaining balance on the vehicle loan.
FINDINGS:
The Registrar found that the allegations were not proven on a balance of probabilities and the matter was dismissed. The Consumer Complainant’s claims for reimbursement and the Authority’s claim for reimbursement of its costs were also dismissed.
