COMPLAINANT: Vehicle Sales Authority of BC (the “Authority”)
LICENSEES: 715 Motor Haus Ltd. (“715”) and Hao Guo (“Mr. Guo”)
Background
Following a written hearing (link to decision) in which the Registrar found that 715 and Mr. Guo had contravened section 33(2)(h) of the Motor Dealer Act Regulation for failing, in the course of business, to safeguard records in respect of a consumer that were in their possession or control, the Registrar requested further written submissions from the parties regarding penalty and costs.
Penalty:
The Registrar found that the following penalties were appropriate:
The motor dealer registration of 715 was suspended for a period of 21 days effective December 17, 2025.
The salesperson license of Mr. Guo was suspended for a period of 21 days effective on receipt of the decision.
An administrative penalty of $65,000 was imposed on 715.
An administrative penalty of $25,000 was imposed on Mr. Guo.
715 and Mr. Guo were ordered to reimburse the Authority 50% of it’s costs, including actual legal costs, in the amount of $9,316.77.
