Complainant: Vehicle Sales Authority of BC

Licensee/Unlicensed person:
A&A Auto Sales Ltd. dba Auto Clearance Downtown Hastings (#40660), Aykut Bilgin (#201174)

Issues:

  • A&A Auto Sales Ltd.โ€™s (โ€œA&Aโ€) registration as a motor dealer expired at midnight on November 29, 2019.
  • A&A submitted its application to renew registration on November 30, 2019 to the Authority by way of e-mail; however, payment was not received until December 9, 2019.
  • The Authority made the decision that it could not complete its review of the application for renewal of registration until other ongoing allegations, regarding a similar nature, were dealt with by the Registrar.
  • The Authority mailed a letter addressed to A&A on December 10, 2019 stating its position regarding the application to renew registration.
  • In response to the December 10 letter, A&A requested an emergency hearing for the Registrar to review the decision of the Authority.

Outcome:

  • The Registrar found that A&A did not renew their motor dealer registration on time. Even if they had submitted the Renewal Application Form and prescribed fee on time, that did not mean they would automatically be renewed.
  • The Registrar found that the Authority submitted allegations that A&A is not abiding by the conditions of their registration, but did not submit any evidence. Therefore, the Registrar cannot legally intervene to stay the application for renewal.
  • The Registrar granted a renewal of A&Aโ€™s registration as a motor dealer for a four month term and subject to terms, conditions and restrictions.
