Complainant: Vehicle Sales Authority of BC

Licensee/Unlicensed person:
Justin Kyle Plosz

Issues:

  • Mr. Plosz applied for a salesperson licence.
  • Mr. Plosz has an extensive criminal record of concern.
  • Mr. Plosz has pending criminal charges of a similar nature that stem from a vehicle transaction, which is directly related to this industry.
  • Mr. Plosz failed to advise the VSA of his then forthcoming Alberta Motor Vehicle Industry Council (“AMVIC”) administrative review of his salesperson licence in Alberta.

Outcome:

  • The Registrar found that Mr. Plosz’s past criminal convictions, his being refused a salesperson licence in Alberta, and his failing to advise the Authority of his AMVIC review indicate that he cannot be trusted.
  • The Registrar found that Mr. Plosz cannot be trusted to act with honesty and integrity and this also raises a concern about his governability.
  • The Registrar refused to licence Mr. Plosz as a salesperson at this time.
  • The Registrar will not accept an application for licensing or registration under the Motor Dealer Act from Mr. Plosz for a period of three years from the date of this decision (October 22, 2022) – subject to the 2017 criminal charges having been addressed.
