Complainant: Vehicle Sales Authority of BC

Licensee/Unlicensed person:
N.W. Auto Depot Ltd. (#10578) and Westminster Motors Ltd. (#40469)

Issues:

  • A hearing was called as the Authority sought an interim order to suspend the dealer registrations of N.W. Auto Depot Ltd. (#10578) and Westminster Motors Ltd. (#40469) (“Dealers”).
  • It was alleged that the Dealers were selling unsafe motor vehicles to consumers and continuing to do so in disregard for conditions placed on their registrations and previous cautions and directions given to the Dealers by the Registrar.

Outcome:

  • The Registrar found there was sufficient evidence to establish a prima facie case that the Dealers were offering for sale and selling unsafe vehicles to consumers and that a serious concern for public safety existed.
  • The Registrar found there was sufficient evidence to show the conditions placed on the Dealers’ registrations and the Registrar’s prior cautions and directions had failed to have the desired effect of reducing risk of harm to the public.
  • The Registrar suspended the Dealers’ motor dealer registrations until further order of the Registrar. The suspension takes effect on September 5, 2018.
