Complainant: Vehicle Sales Authority of BC

Licensee/Unlicensed person:
Ivan Diaz Lara (#121895)

Issues:

  • A hearing was called to review the salesperson licence of Ivan Diaz Lara, #121895 due to an allegation that Mr. Lara retained $3,000 from a consumer instead of giving it to the dealership and charged the consumer an additional $500 that the dealership had not authorized.

Outcome:

  • The Registrar found that:
  1. Mr. Lara had been properly served the Hearing Notice, Compliance Investigation Report, and the Licensing Hearing Report in this matter.
  2. Mr. Lara had failed to attend the Hearing.
  • The Registrar found that:
  1. Mr. Lara breached Section 6 of the Salesperson Licensing Regulation.
  2. Mr. Lara’s conduct is such that it is not in the public interest for him to be continue to be licensed.
  • The Registrar imposed an immediate interim suspension on Mr. Lara’s licence after the hearing, pending a written decision.
  • The Registrar revoked Mr. Lara’s licence permanently.
  • The Registrar set a four-year waiting period, before which Mr. Lara may reapply for a salesperson licence.
  • The Registrar ordered Mr. Lara to reimburse the VSA for its costs, associated with investigating and hearing his conduct as it pertains to his licence.
