Registrar’s Decision 17-09-001

File Number: 17-09-001

In the matter of Motor Dealer Act R.S.B.C. 1996 C.316
and Salesperson Licensing Regulation B.C. Reg. 241/2004

Complainant: Vehicle Sales Authority of BC

Licensee/Unlicensed person:
Elisabeth Kirstina Kovacs (#206825)

Issues:

  • A Hearing was called to review the salesperson licence of Elisabeth Kovacs.
  • It was alleged that Ms. Kovacs took a significant sum of money from her then employer, Milani and Norman Auto Sales and Leasing (#31067)
  • The VSA conducted an investigation and provided Ms. Kovacs an opportunity to attend the hearing to reply to the allegations.
  • Ms. Kovacs did not attend the hearing. The Registrar continued with the hearing in accordance with the Motor Dealer Act and the Salesperson Licensing Regulation.
  • Ms. Kovacs is not currently employed as a salesperson at a dealership.

Outcome:

  • The Registrar reviewed the evidence presented from the Authority and found that the public would be concerned if Ms. Kovacs was allowed to continue to be licensed as a salesperson.
  • The Registrar found that it was necessary to protect the public interest by cancelling Ms. Kovacs’ salesperson licence effective the date of the decision.
  • The Registrar will not accept an application from Ms. Kovacs for a minimum of four years from the date of the decision, subject to her having repaid Milani.
