Complainant: Vehicle Sales Authority

Licensee/Unlicensed person:

Aida Saba (Proposed Salesperson Licence #110012)

Issues:

  • A Hearing was called to review the salesperson licence application of Aida Saba who was previously licensed as a salesperson as well as the owner and operator of Vancouver Top Cars Ltd. between 2006 and 2011.
  • The Authority was concerned of Ms. Saba’s prior management of Vancouver Top Cars Ltd. which closed in late 2011 and owing $19,000 to the Motor Dealer Customer Compensation Fund.

Outcome:

  • The Registrar found that Ms. Saba’s evidence was credible.
  • Ms. Saba offered to pay $19,000 to the Motor Dealer Customer Compensation Fund on a payment plan.
  • Ms. Saba said she would be working in marketing at Auto Max Motors Ltd. and applied for a salesperson licence so she is able to answer customer’s questions.
  • The Registrar was satisfied on all the evidence that if Ms. Saba was granted a salesperson licence on conditions, the risk of future harm to consumers dealing with Ms. Saba while at Auto Max Motors Ltd.
  • The Registrar granted Ms. Saba a salesperson licence on the following conditions:
  1. To be employed as a salesperson only at Auto Max Motors Ltd. unless prior written approval from the Authority is obtained to change employment as a salesperson to another motor dealer;
  2. Not to be in a management position without the prior written approval of the Authority;
  3. Not to handle consumer money; and
  4. To repay the $19,000 to the Motor Dealer Customer Compensation Fund in the manner agreed to by Saba Aida.
  • After six months’ time, the Manager of Licensing is authorized to review, to amend, to continue or to remove conditions (a), (b) and (c). Condition (d) may not be removed until the full amount is repaid.
