Complainant: Vehicle Sales Authority

Licensee/Unlicensed person:

Stephen L. Tyers (Proposed Salesperson Licence #206059)

Issues:

  • A Hearing was called to review the salesperson licence application of Stephen Tyers.
  • The staff of the Authority raised concerns regarding Mr. Tyers’ criminal conviction for sexual assault.

Outcome:

  • Mr. Tyers stated he was wrongfully convicted. The Registrar stated that as a matter of law he could not ignore or overturn the criminal conviction.
  • The Registrar found Mr. Tyers’s criminal conviction was related to the issuance of a salesperson licence and considered the relevant factors.
  • The Registrar considered the evidence presented by Mr. Tyers which included letters of reference.
  • The Registrar was concerned that it is not in the public interest that Mr. Tyers be licensed as a salesperson at this time as he needs to continue his rehabilitation to reduce the level of risk to the public.
  • The Registrar can review another application from Mr. Tyers once he has completed his rehabilitation work and his probation.
