Complainant: Vehicle Sales Authority

Licensee/Unlicensed person:

Spencer Jaymes Hedges (Proposed Salesperson Licence #121010)

Issues:

  • A hearing was called to review the salesperson licence application of Spencer Jaymes Hedges who was convicted of fraud in 2014 due to being found in possession of his truck that he earlier reported stolen to ICBC. Mr. Hedges chose to recover the truck after it was stolen from him and failed to report recovering the truck to ICBC and the police.

Outcome:

  • The Registrar considered whether Mr. Hedges’ conduct indicated that it was not in the public interest to license him.
  • The Registrar heard evidence of Mr. Hedges’ rehabilitation, remorse, acceptance of past conduct, restitution and other positive steps taken to address any aggravating factors.
  • The Registrar was satisfied that Mr. Hedges had taken self-improvement courses, was cooperative throughout the Authority’s review, showed remorse and was paying restitution.
  • The Registrar considered that two years had lapsed since Mr. Hedge’s conviction and the completion of his conditional sentence.
  • The Registrar noted that Mr. Hedges complied fully with and completed his probation requirements without incident.
  • The Registrar granted Mr. Hedges a conditional salesperson licence with the following conditions:
  1. To not be in a management position without prior approval of the VSA; and
  2. To not handle consumer money.
  • The conditions would be reviewed after six months, July 19, 2017, by the Manager of Licensing.
