ROBERT TAGGART (Salesperson #116872)

Issues:

  • Robert Taggart failed to comply with an Undertaking given pursuant to section 154 of the Business Practices and Consumer Protection Act and dated August 19, 2015, in which he undertook to:
    a) Pay an Administrative Penalty in the amount of $500 ; and
    b) Successfully complete a Salesperson Certification Course within 90 days of signing the Undertaking.
  • A hearing was called to consider whether it was in the public interest that Robert Taggart’s salesperson licence have conditions placed on it, be suspended or be cancelled.

Outcome:

  • The evidence provided showed that Robert Taggart had not taken the salesperson course within the time required by the Undertaking or pay the administrative penalty. The staff of the VSA agreed to an extension of time and Mr. Taggart paid for the salesperson course, but did not attend the course at the required time. He still had not paid the administrative penalty.
  • Mr. Taggart apologized for not complying within the times required by the Undertaking or within the extension of time the VSA staff allowed. Mr. Taggart indicated hardship.
  • Mr. Taggart said he was now in a position to pay the administrative penalty.
  • The Registrar adjourned the Hearing sine die and ordered Robert Taggart to attend the next available Salesperson Certification Course (February 2 and 3) and to pay the Administrative Penalty on this date.
  • If Robert Taggart failed to complete the orders, a further hearing would be held to consider suspending his licence and further administrative penalties.
