Issues:

  • Mr. Field was called to a hearing to review his salesperson licence for failure to complete his Continuing Education (CE) requirements.

Outcome:

  • The evidence showed Mr. Field was sent a letter from the VSA dated August 11, 2014, advising him of his condition to complete the CE requirements by December 7, 2014.
  • Mr. Field provided evidence that he did not receive the August 11, 2014, letter and did not receive any emails from the VSA prior to December 7, 2014, advising him of his CE requirements.
  • The Registrar accepted the evidence that Mr. Field had not received the letter of August 11, 2014, and the VSA confirmed no email had been sent to him prior to December 7, 2014.
  • The Registrar ordered the Hearing Notice issued to Mr. Field dated January 22, 2015, be set aside and that Mr. Field has 90 days from the hearing date to complete his CE requirements.
  • The Registrar found no breach of the legislation or conditions of license.
