Licensee/Unlicensed person:

PINNACLE CAR SALES AND LEASING LTD.

Issues:

  • A hearing was called pursuant to sections 6 and 7 of the Salesperson Licensing Regulation (the “Regulation”) to review the conduct of Pinnacle Car Sales and Leasing Ltd. (“Pinnacle”). The areas of concern were:
  1. Operating with unlicensed salespeople;
  2. Allowing Peter Fryer, who was denied a salesperson licence by the Registrar at a hearing on December 4, 2013, to work as a vehicle salesperson at the dealership; and
  3. Not providing a valid municipal business licence for the current operating address of 16065 Fraser Highway, Surrey, B.C.

Outcome:

  • Pinnacle advised the Registrar that they obtained legal counsel and requested an adjournment to allow time to prepare.
  • Given that adequate notice of the Hearing was not given, the Registrar granted the adjournment placing the following conditions on Pinnacle’s licence:
  1. Pinnacle is to provide to the VSA by January 20, 2015, a valid City of Surrey Business Licence or assurance from the City of Surrey on their letterhead that a valid Business Licence will be forthcoming. Legal Counsel for Pinnacle have leave to make further submissions on this condition;
  2. Pinnacle is to provide to the VSA by December 4, 2014, all payroll records for Baldip Sachdeva (Romy); and
  3. Pinnacle is to provide to the VSA by November 28, 2014, a dealership policy manual detailing the processes in place to ensure that all vehicle salespeople at the dealership are properly licensed.
