Issues:

  • Marcelo Bihis was called to a hearing for failing to comply with a condition on his Salesperson Licence to complete the Level II Salesperson Certification Course by December 31, 2013.
  • The purpose of the hearing was to consider whether it was in the public interest that Marcelo Bihis’ Salesperson Licence have additional conditions/restrictions placed on it, be suspended, or be cancelled.

Outcome:

  • Mr.Bihis had a history of deferring taking the course and had been accommodated by the Authority for 4 years.
  • Pursuant to sections 6 and 7 of the Salesperson Licensing Regulation the Registrar found it was not in the public’s interest that Mr. Bihis continue to be a licenced salesperson and suspended his licence until he has completed his education requirement.
  • The suspension of Mr. Bihis’ salesperson licence is effective immediately.
  • The suspension will remain in effect until such time as Mr. Bihis, at his own cost, successfully completes the Level II Salesperson Certification Course.
