Issues:

  • Stephen Ironside applied for a salesperson licence.
  • Stephen Ironside declared his USA conviction but said the Authority cannot consider it.
  • Stephen Ironside created a legal argument that Canada and the courts do not recognize a USA conviction.
  • Stephen Ironside was once the owner of a motor dealership from the mid-1990’s to 2002.
  • Stephen Ironside also alleged bias against the compliance officer.

Outcome:

  • The USA conviction was reviewable conduct for a licensing decision.
  • There was no evidence of bias on the part of the compliance officer.
  • Mr. Stephen Ironside’s legal argument was wholly unsupportable.
  • Mr. Stephen Ironside’s conduct during the hearing showed an attempt to intimidate the Registrar’s exercise of discretion.
  • Mr. Stephen Ironside’s application for a salesperson licence was denied.
  • Mr. Stephen Ironside cannot reapply for a licence for three years. He cannot apply for a motor dealer registration until he has been a salesperson in good standing for at least two years.
