Issues:

  • Mr. Taheri applied to be licensed as a salesperson.
  • A criminal record check showed that he was
  • charged with crimes in Ontario, but there were as yet no convictions.
  • The search also found that there was a warrant for Mr. Taheri’s arrest in Ontario for failing to appear before the Cour

Outcome:

  • As the charges are as yet unproven, they cannot be considered criminal convictions.
  • However, the charges and warrant for arrest needed to be dealt with and considered before issuing a licence could be considered.
  • There was a concern that Mr. Taheri’s failure to abide by a court order in Ontario reflects on his willingness to disobey any future order of the Registrar.
  • Mr. Taheri’s application was not denied. Instead it is being held in abeyance generally until Mr. Taheri has dealt with his Ontario charges and outstanding warrant.
  • His application will be reviewed after the charges are dealt with and considering any future facts.
