Issues:
Mr. Taheri applied to be licensed as a salesperson.
A criminal record check showed that he was
charged with crimes in Ontario, but there were as yet no convictions.
The search also found that there was a warrant for Mr. Taheri’s arrest in Ontario for failing to appear before the Cour
Outcome:
As the charges are as yet unproven, they cannot be considered criminal convictions.
However, the charges and warrant for arrest needed to be dealt with and considered before issuing a licence could be considered.
There was a concern that Mr. Taheri’s failure to abide by a court order in Ontario reflects on his willingness to disobey any future order of the Registrar.
Mr. Taheri’s application was not denied. Instead it is being held in abeyance generally until Mr. Taheri has dealt with his Ontario charges and outstanding warrant.
His application will be reviewed after the charges are dealt with and considering any future facts.
