Registrar's Decision

Registrar's Decision 10-013

File Number: 10-013

In the matter of THE MOTOR DEALER ACT R.S.B.C.1996 C.316
and THE BUSINESS PRACTICES AND CONSUMER PROTECTION ACT S.B.C. 2004 c.2

Complainant: REGISTRAR

Licensee/Unlicensed person:

KEY TRACK AUTO SALES & DETAILING LTD.

Issues:

  • On May 11, 2010, Key Track was denied registration as a motor dealer.
  • It was found that Key Track’s application was an attempt by the principals of Massive Truck to avoid a prior order of the Registrar.
  • Key Track amended its application, now fully disclosing its ownership and management structure.
  • Key Track also provided a guarantee to pay for Massive Trucks penalties and security to cover those penalties.
  • Key Track also took other steps to address the Registrar’s concerns stated in his May 11, 2010 decision.

Outcome:

  • The Registrar granted registration on the same conditions placed on Massive Truck, as well, Key Track’s registration would be suspended if it defaulted on making payments.
