Dear Licensees,
TheΒ Government of British ColumbiaΒ has issued a news release announcing further proposed amendments to theΒ Business Practices and Consumer Protection Act (BPCPA)Β regarding credit reporting.
The proposed legislative changes also include amendments to theΒ Motor Dealer Act (MDA), allowing the Registrar of Motor Dealers to enforce existing rules under theΒ BPCPAΒ that govern when and how motor dealers may obtain a credit report during a consumer transaction.

About the Amendments
The proposed amendments being made in relation to credit reports are:
If the amendments become law, this is how they will apply to licensees/registrants:
(a)Β A licensee/registrant may only obtain a credit report from an individual if they have that individualβs consent, as per section 107 of the BPCPA. This is not new.
(b)Β NEW section 107.1 BPCPA: If a licensee/registrant receives a credit report that has a security alert, the licensee/registrant must
(i)Β If the individual is not present in-person
(A)Β Make reasonable efforts to contact the individual using the information contained in the security alert, and
(B)Β Make a record of the efforts undertaken to contact the individual
(ii)Β If the individual is present in-person
(A)Β verify the identity of the individual, and
(B)Β make a record of the manner in which the verification was made
(c)Β The Registrar will be empowered to investigate complaints that a licensee/dealer did not abide by these requirements.
